Employee SMS Terms of Use

These Terms govern your use of SMS Pulse, OCuSOFT’s internal text-messaging tool. By signing in and sending messages, you agree to use the tool only as described here. They work alongside the Employee SMS Data Handling Policy, which covers how you protect customer data.
Authorized Use Only
- Use SMS Pulse strictly for legitimate OCuSOFT business — lead follow-up, order and appointment updates, quotes, and customer service.
- Send only on behalf of OCuSOFT, from the approved business number. Do not represent yourself as anyone else.
- Use approved message templates and canned messages where provided, and keep custom messages accurate and on-topic.
Professional Conduct
- Be courteous, clear, and professional. Assume every message could be read aloud in court or screenshotted.
- Provide accurate information. Do not make promises, quotes, or claims you are not authorized to make.
- No harassing, threatening, deceptive, discriminatory, profane, or personal/social messages.
- Do not contact a customer more often than necessary, and stop the thread once their need is met.
Consent & First-Contact Rules (10DLC)
- Only message people OCuSOFT has permission or a lawful business reason to text. Never message purchased, scraped, or unconsented numbers.
- First-contact messages must identify OCuSOFT and include opt-out language (“Reply STOP to opt out”). The tool helps with this — do not strip it out.
- Respect quiet hours: send only at reasonable times (generally 8am–9pm in the recipient’s local time).
- Only record an opt-in (in the inbox or admin) when the customer has genuinely agreed to receive texts — they asked you to, said yes on a call, or replied YES/START. Never mark consent a customer did not give; falsely recording opt-in is a compliance violation.
Honor Opt-Outs
- When someone replies STOP, UNSUBSCRIBE, or CANCEL, they are opted out. Never message a suppressed number.
- Do not attempt to circumvent the opt-out list, no alternate numbers, lists, or workarounds to reach someone who opted out.
- Reply HELP requests and re-opt-ins (START / YES) are handled by the system; do not override them manually.
- The system auto-acknowledges inbound replies (an “we received your message” note during staffed hours, an after-hours note otherwise) and pauses it while you’re actively responding — don’t add a redundant “got your message” reply on top of it.
Prohibited Uses
- Personal use, or messaging friends, family, or yourself through the tool.
- Unsolicited marketing or spam, bulk messaging without a lawful basis, or evading carrier/spam controls.
- Sharing your login, sending under another employee’s account, or accessing data you don’t need for your job.
- Exporting or sharing recipient lists or conversations outside OCuSOFT.
Monitoring
SMS Pulse is a company system. Your activity to include but not limited to; sends, replies, and opt-out actions are logged and attributed to your account, and may be reviewed for quality, compliance, and security. You should have no expectation of privacy in your use of the tool.
Violations
Misuse may result in revoked access and disciplinary action up to and including termination. Conduct that violates privacy, consumer-protection, or anti-spam laws (e.g., TCPA) may also expose you and OCuSOFT to legal liability. Texas law governs these Terms.
